PTS and Separation Pay - (DODFMR VOL. 07A-35)

PTS disapprovals are separating at EAOS and entitled to only half Sep Pay if eligible. Refer to OPNAVINST 1900.4 para 8.a.(1) and MPM 1920-040 para 5.a.

IAW BUPERSINST 1900.8, DD214 should read.

Non retention on active duty - JGH - RE-3M/RE-4/RE-6 as appropriate

Sailors separated at HYT or denied extension to HYT due to overmanned rating zones (and have PTS approval) can qualify for full sep pay (MILPERSMAN 1160-120 and attached email refers), DD214 should read:

5. Half-Pay Criteria. The following are the criteria for half pay
eligibility:
a. Expiration of Service Obligation: This category includes servicemembers "not retention eligible" separated at their expiration of active obligated service (EAOS) or HYT.
Servicemembers separated for HYT need not be "advancement eligible" for entitlement to half pay.

3.2. Half Separation Pay (Non-disability). Half payment of non-disability separation pay, computed as provided in paragraph 3.3., below, is authorized to members of the Regular and Reserve components involuntarily separated from AD who meet each of following four
conditions: (In extraordinary instances, Secretaries of the Military Departments concerned may award full separation pay to members otherwise eligible for half separation pay when the specific reasons for separation and the overall quality of the member's service have been such that denial of such pay would be clearly unjust.) 3.2.1. The Service member meets one of the criteria for active service specified in subparagraph 3.1.1., above.
3.2.2. The Service member's separation is characterized as "Honorable"
or "General" as defined in subparagraph E3.2.3.2.2. of DoD Directive
1332.14 (reference (e)), and none of the conditions in paragraph 3.4., below, apply.
3.2.3. The Service member is being involuntarily separated by the Military Service concerned through either the denial of reenlistment or the denial of continuation on AD or full-time National Guard duty, or the Service member is being separated instead of board action as provided in DoD Directive 1332.30 (reference (f)), under one of the following specific conditions:
3.2.3.1. The member is not fully qualified for retention and is denied reenlistment or continuation by the Military Service concerned as provided for in reference (e) or DoD Directive 1332.30 (reference (f)) under any of the following
conditions:
3.2.3.1.1. Expiration of service obligation.
3.2.3.1.2. Selected changes in service obligation.
3.2.3.1.3. Convenience of the Government.

This Executive Order (below) signed by the President on October 1, 2009 was released at the end of a two-day distracted driving summit in Washington. The order applies to federal employees operating government-owned vehicles or driving privately owned vehicles on government business. It also bans the use of government-supplied electronic equipment while driving. Federal contractors are encouraged to implement similar restrictions.

FEDERAL LEADERSHIP ON REDUCING TEXT MESSAGING WHILE DRIVING

By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 7902(c) of title 5, United States Code, and the Federal Property and Administrative Services Act of 1949, as amended, 40 U.S.C. 101 et seq., and in order to demonstrate Federal leadership in improving safety on our roads and highways and to enhance the efficiency of Federal contracting, it is hereby ordered as follows:

Section 1. Policy. With nearly 3 million civilian employees, the Federal Government can and should demonstrate leadership in reducing the dangers of text messaging while driving. Recent deadly crashes involving drivers distracted by text messaging while behind the wheel highlight a growing danger on our roads. Text messaging causes drivers to take their eyes off the road and at least one hand off the steering wheel, endangering both themselves and others. Every day, Federal employees drive Government-owned, Government-leased, or Government-rented vehicles (collectively, GOV) or privately-owned vehicles (POV) on official Government business, and some Federal employees use Government-supplied electronic devices to text or e-mail while driving. A Federal Government-wide prohibition on the use of text messaging while driving on official business or while using Government-supplied equipment will help save lives, reduce injuries, and set an example for State and local governments, private employers, and individual drivers. Extending this policy to cover Federal contractors is designed to promote economy and efficiency in Federal procurement. Federal contractors and contractor employees who refrain from the unsafe practice of text messaging while driving in connection with Government business are less likely to experience disruptions to their operations that would adversely impact Federal procurement.

Sec. 2. Text Messaging While Driving by Federal Employees. Federal employees shall not engage in text messaging (a) when driving GOV, or when driving POV while on official Government business, or (b) when using electronic equipment supplied by the Government while driving.

Sec. 3. Scope of Order. (a) All agencies of the executive branch are directed to take appropriate action within the scope of their existing programs to further the policies of this order and to implement section
2 of this order. This includes, but is not limited to, considering new rules and programs, and reevaluating existing programs to prohibit text messaging while driving, and conducting education, awareness, and other outreach for Federal employees about the safety risks associated with texting while driving. These initiatives should encourage voluntary compliance with the agency's text messaging policy while off duty.

(b) Within 90 days of the date of this order, each agency is directed, consistent with all applicable laws and regulations: (i) to take appropriate measures to implement this order, (ii) to adopt measures to ensure compliance with section 2 of this order, including through appropriate disciplinary actions, and (iii) to notify the Secretary of Transportation of the measures it undertakes hereunder.

(c) Agency heads may exempt from the requirements of this order, in whole or in part, certain employees, devices, or vehicles in their respective agencies that are engaged in or used for protective, law enforcement, or national security responsibilities or on the basis of other emergency conditions.

Sec. 4. Text Messaging While Driving by Government Contractors, Subcontractors, and Recipients and Subrecipients. Each Federal agency, in procurement contracts, grants, and cooperative agreements, and other grants to the extent authorized by applicable statutory authority, entered into after the date of this order, shall encourage contractors, subcontractors, and recipients and subrecipients to adopt and enforce policies that ban text messaging while driving company-owned or -rented vehicles or GOV, or while driving POV when on official Government business or when performing any work for or on behalf of the Government.
Agencies should also encourage Federal contractors, subcontractors, and grant recipients and subrecipients as described in this section to conduct initiatives of the type described in section 3(a) of this order.

Sec. 5. Coordination. The Secretary of Transportation, in consultation with the Administrator of General Services and the Director of the Office of Personnel Management, shall provide leadership and guidance to the heads of executive branch agencies to assist them with any action pursuant to this order.

Sec. 6. Definitions.

(a) The term "agency" as used in this order means an executive agency, as defined in 5 U.S.C. 105, except for the Government Accountability Office.
(b) "Texting" or "Text Messaging" means reading from or entering data into any handheld or other electronic device, including for the purpose of SMS texting, e-mailing, instant messaging, obtaining navigational information, or engaging in any other form of electronic data retrieval or electronic data communication.
(c) "Driving" means operating a motor vehicle on an active roadway with the motor running, including while temporarily stationary because of traffic, a traffic light or stop sign, or otherwise. It does not include operating a motor vehicle with or without the motor running when one has pulled over to the side of, or off, an active roadway and has halted in a location where one can safely remain stationary.

Sec. 7. General Provisions.

(a) Nothing in this order shall be construed to impair or otherwise affect or alter:
(i) Authority granted by law or Executive Order to an agency, or the head thereof;
(ii) Powers and duties of the heads of the various departments and agencies pursuant to the Highway Safety Act of 1966, as amended, 23 U.S.C. 402 and 403, section 19 of the Occupational Safety and Health Act of 1970, as amended, 29 U.S.C. 668, sections 7901 and 7902 of title 5, United States Code, or the Federal Property and Administrative Services Act of 1949, as amended, 40 U.S.C. 101 et seq.;
(iii) Rights, duties, or procedures under the National Labor Relations Act, 29 U.S.C. 151 et seq.; or
(iv) Functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity, by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Secretary of Veterans Affairs Eric K. Shinseki has authorized advance payments up to $3,000 for Veterans who applied for VA educational benefits and who have not yet received their monthly education payments.

If you are a Veteran who has applied for one of VA’s education programs and have not yet received your monthly benefit payment for the Fall 2009 term, you can request advance payment through this website, www.advancepay.gibill.va.gov.
Advance payments will be issued by the U. S. Treasury within 3 workdays (Monday through Friday) following submission of this request. Payments will be in the form of a check sent through the U.S. mail. You should therefore anticipate an additional 3 days (excluding Sundays) for the U.S. Postal Service to deliver your check.
You can also visit one of VA’s 57 regional offices across the country to immediately receive an advance payment. You will need to bring a government-issued photo ID and your course schedule when you visit the regional office.
Starting on October 2, regional offices will be open from 8:00 am to 6:00 pm on weekdays for advance payments. Regional offices will also be open on Saturday, October 3, from 8:00 am to 12:00 noon. The advance payments will be reconciled with future education payments owed to you.

Question: Am I eligible for the education advance payments?
Answer: If you are a Veteran who is eligible under one of VA’s education programs and currently enrolled in school, and you have not yet received your monthly benefit payment, you are eligible for an advance payment.
Question: How much money will VA give me?
Answer: Payments of up to $3,000 will be made to Veterans who have applied for their education benefits but who have not yet received their monthly benefit payment. The amount of your payment will be based upon the benefit payable under your educational program.
Question: How can I get an advance payment?
Answer: Beginning October 2, you can apply on-line at advancepay.gibill.va.gov or you can go to your nearest VA regional office to receive an advance pay. A list of VA regional offices is available at www.vba.va.gov/VBA/benefits/offices.asp.
Question: If I request an advance payment online, when will I get a check?

Answer: You can request free van service, provided by volunteers, to take you to the nearest regional office. To obtain this service, call your nearest VA medical center and ask for the “Volunteer Transportation Coordinator.” Transportation will be on a first-come, first-served, space-available basis. Question: If I received my October 1 education payment, am I still eligible for a $3000 advance payment?
Answer: No, advance payments are only authorized for Veterans who have not yet received their monthly payments for the fall 2009 school term.
Question: Can I receive more than one advance payment?
Answer: Only one payment is authorized per Veteran, up to $3,000.
Question: Will I have to pay this advance payment back to VA?
Answer: The payment will be recouped from your future VA payments. However, if you stop attending school during the semester or reduce your course load to a level that affects your monthly benefit, full recoupment by VA may not be possible, and you will have to repay any remaining balance.

$555 Million DoD Homeowners Assistance Program Details Announced
The Department of Defense (DoD) today announced details for the temporary expansion of the Homeowners Assistance Program (HAP). Using $555 million in funds from the American Recovery and Reinvestment Act (ARRA), this program is designed to partially reimburse eligible military personnel, surviving spouses, and federal civilian employees whose service to the nation has required them to relocate and sell their primary residence at a loss.
Potential eligible personnel include:

- Active and former service members of the Army, Navy, Marine Corps, Air Force, and Coast Guard;

- Civilian employees of the DoD, Coast Guard, and non-appropriated fund activities; and

Potential eligible personnel who have sold a primary home for a loss or are considering selling their home are encouraged to visit the DoD HAP Web site (http://hap.usace.army.mil) to check specific program criteria, and if eligible, apply online.

The DoD HAP has been providing financial assistance to military personnel and DoD civilians since 1966, mainly at base realignment and closure (BRAC) sites where government action caused a decrease in market home values. While the HAP expansion is not designed to pay 100 percent of losses or to cover all declines in value, it can help protect eligible applicants from financial catastrophe due to significant losses in their home values.

Supporting military families is one of administration's highest priorities and includes leadership and engagement by Michelle Obama and Jill Biden. In February 2009, the Congress provided ARRA funding for a temporary expansion of the HAP to address unique economic pressures faced by military personnel who are forced to relocate during these unusually adverse housing market conditions. After conducting an extensive analysis to determine how best to prioritize the finite funds available while maximizing assistance to as many people as possible, the DoD developed specific eligibility criteria designed to take care of people in the greatest need. These program details have been published in the Federal Register and are now available for public comment.

ARRA funding allows the DoD to temporarily expand HAP to partially reimburse losses from the sale of a primary residence in the following priority order:

1. Homeowners wounded, injured, or ill in the line of duty while deployed since Sept. 11, 2001, and relocating in furtherance of medical treatment;

2. Surviving spouse homeowners relocating within two years after the death of their spouse;

3. Homeowners affected by the 2005 BRAC round, without the need (which existed under previous law) to prove that a base closure announcement caused a local housing market decline; and

4. Service member homeowners receiving orders dated on or after Feb. 1, 2006, through Dec. 31, 2009, for a permanent change of station (PCS) move. The orders must specify a report-no-later-than date on or before Feb. 28, 2010, to a new duty station or home port outside a 50-mile radius of the service member's former duty station. These dates may be extended to Sept. 30, 2012, based on availability of funds.

Each of these general categories has more specific eligibility requirements which have been updated at the DoD HAP Web site (http://hap.usace.army.mil). The U.S. Army Corps of Engineers executes the program for all the military branches and HAP administrators will immediately start processing applications.

PTS WITH SELRES OPTION

Effective 1 October 2009, The PTS appliction system will give Sailors the option to obtain quotas for affiliation/enlistment in the Selected Reserves(SELRES). This allows Active duty Sailors and FTS Sailors to apply for both Active Duty/FTS quota and SELRES quota in the same application. SELRES Zones differ from Active Duty zones and are based on Pay Entry Base Date (PEBD)(PTS will determine the applicable zone) AS INDICATED:

A. ZONE A (0-8 YEARS)
B. ZONE B (8-14 YEARS)

Sailors that are 12 month from the end of their complete contract (EAOS and SEAOS match) can apply until they are 3 months from their end of obligated service. Those Sailors who currently have a final Active Duty/FTS quota can still apply for a SELRES quota. Those Sailors who are within 3 month of seperating are not authorized to submit SELRES applications.

Policy note: PACT/GENDET Sailors: Effective 01 OCT 09, PACT/GENDET Sailors are not longer authorized to submit PTS applications, they must utilize the REGA program in FLeet RIDE to request "A" schools assignments, Navy Wide Advancement Exam, Direct Designation and Change of Career Path quotas. The only exception to this policy are those Sailors who are currently in their PTS window, they are required to continue to use PTS until a final determination is made...

MILITARY HOMEOWNERS ASSISTANCE PROGRAM

The 2009 American Economy Recovery Act had a provision that assisted military personnel that had to PCS during the current mortgage and housing crisis.

The U.S. Army Corps of Engineers was already running the Homeowners Assistance Program for families affected by BRAC closures and were tasked with developing an expanded program to include anyone losing their home or negatively affected by the forced sale of their home between 01 FEB 2006 and 30 SEP 2012.
This has taken time to get approved through DoD and the federal government.

Evidently the DoD and Office of Management & Budget have finally resolved the issues concerning utilization of the American Economy Recovery Act and authorized funding the expansion of the military Homeowners Assistance Program.

Military personnel that are required to PCS more than 50 miles from their current primary residence between 1 FEB 2006 and 30 SEP 2012 are eligible for assistance.
